1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the COTI website (www.cotinewyork.com) and the purchase of products from COTI LLC ("we," "our," or "us").

By accessing our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

2. Products & Descriptions

We make every effort to accurately display product information, including descriptions, ingredients, and images. However, we do not warrant that product descriptions or other content are error-free. Colors and packaging may vary slightly from what is shown online.

3. Ordering & Payment

By placing an order, you confirm that the information you provide is accurate and complete.

We reserve the right to refuse or cancel orders for legitimate business reasons, including suspected fraud, pricing errors, product unavailability, or circumstances that prevent us from fulfilling an order.

If we cancel an order after payment has been collected, we will notify you and promptly refund the amount collected for the canceled items, together with any applicable taxes and shipping charges attributable to those items.

• All prices are listed in U.S. dollars (USD).

• Payment is due at the time of purchase.

• We accept major credit cards and other payment methods as displayed at checkout.

• You will receive an order confirmation email once your purchase is processed.

4. Shipping & Delivery

We currently ship within the United States.

Estimated delivery times and applicable shipping charges are provided at checkout before you complete your purchase.

We will comply with any shipping or delivery commitments made at the time of purchase and with applicable law.

Subject to the following paragraph and applicable law, COTI LLC is not responsible for delays caused by shipping carriers or events outside our reasonable control.

If we cannot ship your order within the time stated when you placed it, or within 30 days if no shipment time was stated, we will notify you and provide the delay, cancellation, and refund options required by applicable law. Carrier delays and events outside our reasonable control do not override these obligations.

We work with third-party shipping carriers to deliver your order.

If your package is lost, stolen, or arrives damaged, please contact us at hello@cotinewyork.com with your order number. We will review the circumstances, work with the shipping carrier where appropriate, and assist with a resolution, which may include a replacement or refund.

Nothing in this section limits any rights or remedies available under applicable law.

5. Returns & Refund Policy

30-Day Return Window

Return or refund requests under our voluntary return policy must be submitted within 30 days of the delivery date.

Unopened Products

Unopened products in their original condition may be returned for a refund of the product purchase price, excluding original shipping charges.

To initiate a return, please contact us at hello@cotinewyork.com with your order number. We will provide return instructions.

Once the returned product has been received and inspected, we will confirm whether the return is approved.

Opened Products

If you have tried a product and are not satisfied, please contact us at hello@cotinewyork.com with your order number and a brief explanation.

We will review your request individually and determine whether a refund is appropriate under our voluntary satisfaction policy.

Sale Items & Proof of Purchase

Sale and discounted items are eligible for returns under the same conditions unless a different return condition was clearly disclosed before purchase and is permitted by applicable law.

A valid order number, receipt, or other reasonable proof of purchase is required to verify your order.

Return Shipping & Fees

Customers are responsible for return shipping costs for ordinary returns unless otherwise stated.

For products that arrive damaged, defective, or incorrect, please contact us so we can arrange an appropriate resolution at no additional cost where required by applicable law.

We do not charge restocking fees for approved returns under this policy.

Refund Processing

For approved returns under our voluntary return policy, we will initiate the refund to the original payment method within 5–10 business days after final approval.

For unopened products returned to us, final approval follows receipt and inspection of the returned item.

Your payment provider may require additional time to post the refund to your account.

Abuse or Fraud

We reserve the right to limit or deny voluntary refund requests in cases of suspected abuse or fraud, subject to applicable law.

Consumer Rights

This 30-day return policy is voluntary and separate from refunds or remedies required by law.

Nothing in this policy limits or overrides any non-waivable consumer rights, mandatory refund obligations, or other remedies available under applicable law.

Any refund required by law will be processed within the applicable statutory deadline, regardless of the voluntary processing period stated above.

The content on our website is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

You agree to indemnify and hold harmless COTI LLC, its officers, employees, and agents from third-party claims, damages, liabilities, or reasonable expenses to the extent arising out of your material violation of these Terms, unlawful misuse of the website, or infringement of a third party's rights.

This provision applies only to the extent permitted by applicable law and does not limit any non-waivable consumer rights or remedies.

10. Governing Law

These Terms are governed by the laws of the State of New York, United States, except to the extent that applicable law requires otherwise.

This choice of law does not deprive you of any mandatory consumer protections that apply to you.

Contacting us first is voluntary and does not limit your right to seek relief through a court of competent jurisdiction or any other remedy available under applicable law.

These Terms do not require binding arbitration.

We will post the revised Terms with an updated "Last Updated" date and provide any additional notice or obtain consent required by applicable law.

Revised Terms apply prospectively and do not retroactively change the terms governing an order already placed, unless required by law or separately agreed with you.
